Daniel J. Hurson has authored the article "Before You Sue The Accountants" which appears in the April 2006 issue of The Practical Lawyer. The article explores various considerations and pitfalls inherent in any lawsuit against auditors for professional malpractice. Mr. Hurson explores the applicability of Section 552 of the Restatement of Torts, the importance of determining the relationship between your client and the auditor, reviewing management representation letters and financial statements, and the increasing use of the imputation defense, among other issues. Daniel J. Hurson has been elected as Chairman of the Steering Committee of the Corporation, Finance and Securities Law Section of the District of Columbia Bar. The Section represents several thousand attorneys in the corporate, banking, finance and securities practice areas. Mr. Hurson will coordinate the activities of the numerous committees of the Section, as well as participate in programs of relevance to the section.
In December 2006 The Hurson Law Firm was appointed by the Bankruptcy Court for the Eastern District of Virginia as Special Counsel for the Xybernaut Corporation. The Hurson Law Firm was responsible for assessing and recommending to the company potential third-party litigation on behalf of the estate. Xybernaut, a newly reorganized Virginia-based high-tech firm, filed for bankruptcy in 2005 amid allegations of financial improprieties by former managers. In July 2007, The Hurson Law Firm filed a 67 page, twenty-four count Complaint in the Circuit Court for Fairfax County Virginia alleging various tort and contract violations against eleven former officers, attorneys, accountants and advisors to the company.
Daniel J. Hurson has appeared on a DC Bar Panel Discussions regarding recent developments in the SEC's enforcement program, and recent developments in the Foreign Corrupt Practices Act. Mr. Hurson also moderated a DC Bar Panel Discussion on the subject of attorney liability after Sarbanes-Oxley.
The Hurson Law Firm is representing individuals in several investigations brought by the SEC under the Foreign Corrupt Practices Act, and in connection with options backdating issues.
